32. Thomas B.5 Swearingen (John4, Thomas3 Vansweringen, Garrett2, David Janse1 Swieringh) was born September 23, 1728 in Montgomery County, Md., and died October 15, 1794 in Montgomery Co., Md.. He married (2) Ruth Beall 1750.

Thomas B. Swearingen's birth is recorded in Episcopal Church Records in Queen Anne Parish (which is now Prince George Co. He is listed as son of John and Mary. It is not certain that he has the initial "B" in his name. Some researchers have so stated.
Prince George's Episcopal Church records, which included a chapel in what is now Montgomery County, lists the following:
Mary Swearingen, b. 19 August, 1760, daughter of Thomas and Ruth
Abed (Obed) Swearingen, b. 28 May, 1762, son of Thomas and Ruth
Samuel Swearingen, b. 22 November, 1765, son of Thomas and Ruth
On June 1, 1775, Thomas Swearingen purchased 103 acres of the tract Trouble Enough, from Alexander Beall, for 20 pounds. FC Deeds BD#2 f.5
In 1778 Thomas Swearingen, planter, purchased from William Baker, doctor, 79 acres of Amelias Dislike (Millys), for 395 pounds. MC Deeds A. f158.
in 1779 William Baker executed a deed conveying to Thomas, part of Millys Dislike and part of the adjoining Resurvey on Batchelors Forest, totaling 569 acres, for 5000 pounds. MC Deeds A. f. 430. This is an incredibly large sum of money for that time.
MC Deeds Book A. f. 530: Dated July 17, 1780: Thomas Swearingen, planter, bought 230 acres of Bradfords Rest "beginning at a bounded hickory standing on the east side of Rock Creek and in the lines of a parcel formerly leased out of Bradfords Rest unto maurice Fitzgerald and running thence up the creek." He paid 1000 pounds.
In 1789, Thomas bought five lots, totaling 907 and 1/2 acres, from George Plater of St. Marys County for 10 pounds. They were part of Bradfords Rest, Lott #1 containing 396 acres; Lotts#4, 6, and 8, 365 and 1/2 acres; and Lott#12, 146 acres. The descriptions of the lots mentioned adjoining lots, leased to Nicholas Baker, to Samuel Glaze, to Barbary Williams, and to Thomas Swearingen.
Aaron Prather, Sr. executed a deed on March 155, 11793, conveying to Thomas Swearingen, for 150 pounds, 73 acres of Resurvey on Plain Dealing, together with houses, out houses, orchards, woods, underwoods, pastures, waterways and so on. This is most probably the same Aaron Prather married to Thomas' daughter, Mary Swearingen.
The 1777 Montgomery County tax list showed Thomas Swearingen at Rock Creek Hundred with 7 taxables.
The 1790 Montgomery Ciunty Census lists Thomas Swearingen with 2 males 16 years and over, 3 males under 16 years, 6 females, and 21 slaves.
On the eve of his death, in 1793, the Montgomery County tax assessment for Thomas Swearingen in the district that included Rock Creek Hundred we find the following"

Thomas also was assessed for 27 slaves.
In the Third District, the northwestern third of the county, he was assessed for 122 acres of Trouble enough.

Note: There has been a hand-writen note affixed to the margin of the original of this Will, which reads thus: Compared 2-7-41. Name is Ferrell - E.R. Plummer, Deputy. This refers to the many public references made to this Will in which the name 'Ferrell' as in James Ferrell, is mistyped 'Farrell', or 'Terrell'. The handwritten, original Will does, indeed say 'Ferrell'.

In the Name of God, Amen. I Thomas Swearingen of Montgomery County and the State of Maryland being weak in body but of sound perfect mind and memory and understanding considering the certainty of death and the uncertainty of the time thereof and being desirous to settle my worldly affairs and thereby be the better prepare to leave this world when it shall please God to call me home I herefore make and publish this my last will and testament in the manner and form following that is to say,
First and principally I commit my Soul into the hands of Almighty God and my body to the earth to be decently buried at the discretion of my executor herein after named.
Item I give and bequeath to my Son John Swearingen and my daughter Eleanor Ferrell, wife of James Ferrell, Mary Wilcoxson wife of George Wilcoxson and Ruth Burriss wife of Charles Burriss, each five Shillings current money.
Item I give and bequeath to my daughter Elizabeth Wilcoxson wife of John Wilcoxson fifty pounds current money.
Item I give and bequeath to my Son Daniel Swearingen fifty pounds current money.
Item I give and bequeath to my Son Obediah Swearingen fifty pounds current money.
Item I give and bequeath to my Son, Samuel Swearingen fifty pounds current money.
Item It is my will and desire that the whole of my personal property of all kinds whatever be brought to an appraisement and after my wife's thirds are taken out the remainder to be sold at public sale on one years credit by my executor hereafter named and the money arising therefrom to be equally divided amongst all my children except the five first above named likewise all my lots or lotts of ground in Georgetown to be sold as aforesaid and the money arising from the sale of them to be divided as above.
Item I give and bequeath to my Son William Swearingen, his heirs and assigns forever, all my tract of land lying in Frederick County on Bennett Creek being part of a tract of lands called trouble enough which was conveyed to me by Alexander Beall. Likewise fifty pounds current money to be paid him by my executor and then an equal share with the rest of my children, excepting these above excepted, in the money arising from the Sale of my personal property and lotts.
Item I give and bequeath all the remainder of my real estate to my three Sons hereafter named viz. Van Swearingen, Hezekiah Swearingen & Josiah Swearingen, their heirs and assigns for ever to be equally divided between them as they shall arrive to lawful age and it is further my will and desire if either of the aforesaid children should die without lawful heirs, his or their parts of the Said real estate to be divided between the survivors of the surviving one of the three.
Item it is further my will and desire that my wife, Mary Swearingen should possess the real estate above devised to my three sons during the time she remains my widow & to maintain educate the said children, but should she marry before the said children arrive to lawful age she then is to give the said real estate and personal property belonging to the said children up to my two friends Thomas Cramphin/?/ & Allen Bowie whom I appoint guardians & Trustees to my said children in that case.
And lastly I do hereby constitute and appoint my son Elemelick Swearingen solo executor of this my last will and testament revoking and annulling all former wills by me made ratifying and confirming this and no other to be my last will and testament.

Montgomery Couty to wit 15th October, 1794 came Charles Beckwith, Michael Letton and Richard Allison the three subscribing witnesses to the within last will and testament of t\Thomas Swearingen late of said county deceased and severally made oaths on the Holy Evangeles of Almight God that they did see the testator there named sign and seal this will and heard him publish pronounce and declare the same to be his last will and testment, that at this time of his so doing he was to the best of their apprehensions of sound and disposing mind memory and understanding and that they respectively subscribed their names as witnesses to this will in the presence and at the request of the testator and in the presence of each other. An inventory of his goods and chattels was made November 22, 1794. It included wearing apparel, one silver watch, furniture, housewares, and old fiddle, a slate, a large Bible, shoe buckles, knee buckles, a looking glass, tools, farming equipment, 14 horses and mares, livestock, geese, sheep and 23 slaves. Total value was 1614 pounds, 3 shillings, 4and 1/2 pence.
